Terms and Conditions
House to Grow, referred to as ‘HTG’ for the purpose of this document, is an Australian Registered Charity who as well as offering programs to fulfil our mission to the community, organisations and those in need, also develop and sell courses as a source of revenue that is put back into our charity for continued program development and community offerings. Please read carefully these Terms and Conditions.
Prices: All prices are subject to availability and while rare, may warrant amended at any time. Prices may be adjusted due to currency fluctuations for international currency exchanges (if impacted as such). Generally, prices for specific services will not be increased once final payment has been received for that service.
Online shopping: We have super-fast delivery available, Australia-wide. Estimated delivery time is 10-14 working days depending on shipping state. Shipping fee will be displayed in checkout before the final payment step. When using credit card, you pay immediately at checkout. When the package arrives, you pick it up at your local pick-up point. All information concerning your credit card is encrypted and secured. No refunds/exchanges will be issued.
Payments: Can be made by credit/debit card via PayPal. Please note that at payment confirmation the receipt reference will be via our partner payment providers not HTG.
Fees and Charges: HTG does not pass on the surcharge for credit card payments to customers. No fees apply to all forms of payment.
GST: The advertised price of all HTG programs includes GST (Australian Goods and Services Tax)
Amendment/Cancellation Request: HTG will be reasonable and considerate subject any circumstance and will act fairly in the best interest of any situation. We are unable to provide a refund to you until we receive the funds as paid and any request needs to be submitted to HTG within 5 business days from the date of purchase. If a refund is issued by HTG based on any given circumstances as decided by HTG, a 20% fee will still be retained for administration and back of house fees absorbed by HTG for any sale.
Generally, an amendment to a given program can be accommodated but that request needs to be submitted to HTG within 5 business days of purchase.
If HTG cancels the course, then a full refund will be issued for payments made.
Liability: We do not accept any liability whatsoever for the acts, omissions or default, whether negligent or otherwise, of third-party providers over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased product. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by force or any other event which is beyond our control which is not preventable by reasonable diligence on our part or to the extent permitted by law.
Partners: HTG uses various partners for programs, IT platforms or any requirement needed to deliver the HTG program, content and/or courses. HTG’s obligation is to ensure that all partners have the relevant and diligent terms and conditions, data protection policy and any requirement by law to ensure our programs and courses comply with all requirements and protection of our clientele. Our partners do not store and/or retain any HTG clientele information any time, purchasing a course and/or program you agree to HTG’s use of our partner network.
Intellectual Property: All program and course content is and remain the intellectual the property of HTG and it is not to be copied and/or used, distributed or circulated for any other purpose except the purpose of the intended program/course as purchased. HTG are open to discussing other avenues to share the program/course material but these avenues must be communicated to HTG in advance in which such avenues would be explored at the discretion of HTG.
Conflict resolution: Any such case will fall within the standard conflict resolution process, where as a negotiated agreement will be sought first with reference to all Terms and Conditions and HTG Policies. Confidentiality
The parties agree to hold each other’s Proprietary or Confidential Information in strict confidence. “Proprietary or Confidential Information” shall include, but is not limited to, written or oral contracts, trade secrets, know-how, business methods, business policies, memoranda, reports, records, computer retained information, notes, or financial information. Proprietary or Confidential Information shall not include any information which: (i) is or becomes generally known to the public by any means other than a breach of the obligations of the receiving party; (ii) was previously known to the receiving party or rightly received by the receiving party from a third party; (iii) is independently developed by the receiving party; or (iv) is subject to disclosure under court order or other lawful process. The parties agree not to make each other’s Proprietary or Confidential Information available in any form to any third party or to use each other’s Proprietary or Confidential Information for any purpose other than as specified in this Agreement. Each party’s proprietary or confidential information shall remain the sole and exclusive property of that party. The parties agree that in the event of use or disclosure by the other party other than as specifically provided for in this Agreement, the non-disclosing party may be entitled to equitable relief. Notwithstanding termination or expiration of this Agreement, House to Grow and Customer acknowledge and agree that their obligations of confidentiality with respect to Proprietary or Confidential Information shall continue in effect for a total period of three (3) years from the effective date or as otherwise agreed with request.
